人合性这个概念出现在商事法理论研究中,一般是用在公司的学理分类上,例如,“公司按照信用标准分类,亦称为学理标准,即是强调人的信用,还是强调资本的信用,还是两者兼而有之,可以将公司分为人合公司、资合公司和中间公司”。这是人合性概念使用最典型的场合。人合性作为重要的商法基础理论,贯穿于商主体制度产生、发展的历史和现实法律规则之中。对人合性进行理论抽象与归纳并阐述其制度价值是很有必要的。本文立意即在于对人合性的现有理论进行总结,着力于挖掘人合性理论的内在价值,并为相关立法提供理论依据。

The purpose of this article is to summarize the existing theories of human combination, to dig out the intrinsic value of human combination theory and to provide the theoretical basis for the relevant legislation.
