【裁判要旨】出租人与承租人在租赁合同中约定,倘租赁期间,警署迁移至承租房屋特定范围之内,则视为出租人违约,承租人可解除合同,并要求出租人赔偿全部装修及设备费用。法院在上述警署条款约定事项发生,认定出租人应否按约承担违约责任时,应对警署条款的法律效力予以分析,在确定出租人应对可预见的风险承担责任前提下,准确阐述违约责任的涵义,合理界定出租人应承担的法律责任,实现当事人的利益平衡。
