商法的形成是基于商人们自己实践的成果,再由民法及商法学者对实践基础上产生的商事一般规则及特殊规则加以整合与总结,并结合具体的商法适用而形成。故而,法律适用对于商法的形成完善及发展起到了极为重要的作用,而古罗马法作为大陆法系乃至现代世界范围内受罗马法影响而产生的商法之起源,其于法律适用的意义仍为现代商法之发展有极为重要的借鉴作用。故而,本文就试图从古罗马法之于古代商法作用的角度,就法律适用的意义加以分析。
