二战以后人权问题,全面地进入国际法领域。人权问题不再只是一国范围内的事,而成为了全球普遍关注的现代国际关系中的一个重要问题。构成国际人权法基础的是《联合国宪章》、《世界人权宣言》及两个公约,即《公民权利和政治权利国际公约》、《经济、社会、文化国际公约》,后三者因其在国际社会的法律地位、所起的作用及重要性,而被统称为“国际人权宪章”。
Human rights issues after World War II have fully entered the field of international law. The issue of human rights is no longer just a matter within one country, but has become an important issue in the modern international relations that are of universal concern in the world. The cornerstone of international human rights law is the “UN Charter”, the “Universal Declaration of Human Rights” and the two conventions, namely, the “International Covenant on Civil and Political Rights,” and the “International Covenant on Economic, Social and Cultural Rights. The legal status of society, its role and importance, are collectively referred to as the ”Charter of International Human Rights."
