法定期间系指卫生法规中明确规定的期间。卫生法律关系的主体若不在法定期间或者超过了期限完成某项行政(或诉讼)行为,就丧失了进行该项行政(或诉讼)行为的权利,或者是所为的行为无效。因此,熟练掌握和正确计算法定期间尤为重要,本文针对食品卫生监督机构(下称监督机构)违反食品卫生法定期间所造成的后果及其有关问题,谈一点粗浅的看法,供参考。一、违反法定期间的后果1、申请人可以提起诉讼监督机构颁发《卫生许可证》是一种具体行政行为,它是应食品生产经营者的请求,颁发的准许申请人从事食品生产经营活动的书面处理决定,监督机构必须在法定期间内对申请人提出的请求予以答复。按照《食品卫生监督工作程序(试行)》第八条之规定:“监督机构应在收到食品
