只有将行政法律责任与行政法治原则相联系,才能把握其内容和形式。公私合作的兴起给条件模式的合法性行政法治理论带来了极大的挑战,以目的为导向的合法性行政法治理论应运而生,也因此必然伴随着行政法律责任体系的重构。在构建公私合作中的政府行政法律责任体系时,德国担保责任理论只具有导向性价值,它不能在规范意义上提供有效的理论支持;以公私合作的类型为基础,对于行政法律责任内容体系的构建或许是一条可行的路径。
Only by linking the administrative legal responsibilities with the principles of administrative law and order can we grasp its content and form. The rise of public-private cooperation brings great challenges to the legitimacy of the conditional model of administrative law and order theory. The purposeful-oriented theory of legitimacy of administrative law and ruling emerged as the times require, and therefore inevitably accompanied by the restructuring of administrative legal responsibility system. In the process of constructing the system of government administrative legal responsibility in public-private cooperation, the theory of guarantee responsibility in Germany only has the guiding value. It can not provide effective theoretical support in the normative sense. On the basis of the type of public-private cooperation, Build may be a viable path.
