近年来,高校连续发生的集体退学事件引起了社会的广泛关注。人们对高校身份处分权的认识不足和高校管理中行政法治的缺失是造成这一现象的主要原因。为了既尊重高校的办学自主权,又切实维护学生的受教育权,理论上应当将高校处分权区分为身份处分权和非身份处分权。实施身份处分权应当遵循行政法治原则。 In recent years, the continuous withdrawal of students from colleges and universities has aroused widespread concern in the society. The lack of understanding of the right to dispose of college students and the absence of administrative law and rule in higher education are the main reasons for this phenomenon. In order to respect not only the autonomy of running a university but also the students’ right to education, in theory, the right to dispose of higher education should be divided into the right of identity disposition and the right of non-status. The implementation of the right of identity disposition should follow the principle of administrative law.
