《申报》是英国人美查(Frederick Major)于1872年4月在上海创办的一种商报,后来发展成为在近代中国影响最大的中文报纸之一。郭嵩焘是近代中国首任驻英法公使,因《申报》关于他画像、茶会两事报道不实,且语多讥讽凌辱之意,自光绪四年(1878年)九月到次年三月。从巴黎到伦敦再到上海一直追究并拟状诉《申报》。此事被称为近代中国史上“华字报最初最巨之交涉”,是近代中国报界最早的“语言文字之祸”。郭嵩焘也因此成为近代中国历史上学习西法,拿起法律武器维护自己声誉而状诉新闻报刊的第一人。
