区域经济合作是目前世界经济中一个极为重要的发展模式,而中国与东盟之间的合作更是发展迅速。双方签订的《中国—东盟全面经济合作框架协议争端解决机制协议》是落实《中国—东盟全面经济合作框架协议》的重要组成内容,为中国—东盟自由贸易区提供了法律基础和保障,切实有效地促进了双方在经贸领域的合作与进步。虽然《中国—东盟争端解决机制协议》在适用范围和第三方制度方面具有自己的特点,但它在争端常设机构和仲裁庭的组成上也存在诸多缺陷,只有将两者有机地结合起来,才能更好地发挥争端解决机制的作用。
Regional economic cooperation is currently an extremely important mode of development in the world economy. Cooperation between China and ASEAN is even more rapidly developing. The Agreement on Dispute Settlement Mechanism for the Framework Agreement on Comprehensive Economic Co-operation between China and ASEAN signed by the two parties constitutes an important part of implementing the “China-ASEAN Framework Agreement on Comprehensive Economic Co-operation” and provides a legal basis and guarantee for the China-ASEAN Free Trade Area Promoted the cooperation and progress between both sides in economy and trade. Although the China-ASEAN Agreement on Dispute Settlement has its own characteristics in the scope of application and the third party system, it also has many shortcomings in the composition of the dispute standing body and the arbitral tribunal. Only by organically combining the two can Better play the role of dispute settlement mechanism.
