应诉管辖制度在理论上存在着失权、拟制、推定、授权四种构建模式,只有推定合意管辖模式契合我国应诉管辖制度的立法初衷。推定合意管辖模式在域外存在着主观标准和客观标准两种制度类型,但两者在本质上均注重保障被告的管辖利益和避免已经进行的诉讼程序归于无效。《民事诉讼法》第127条第2款没有将诉讼告知作为应诉管辖制度的适用条件,在解释论上应当根据被告的身份及其是否聘请律师,要求受诉法院履行相应的诉讼告知义务,并遵循不同应诉管辖规则。
