依据马克思主义的观点,一方面,刑罚是自由的剥夺者、限制者,使自由在其手中变得不自由;但另一方面,刑罚却是对超越自由界限的自由的惩罚,是对自由地侵犯他人的自由的否定,就其作用和社会意义而言,刑罚又是保护自由、维持自由,在法律界定的范畴内使自由真正得以实现的强有力的法律手段。刑罚对自由具有惩罚与保护的双重性质。自由与刑罚的内在联系,并不是人们主观的臆想,而是一定时代政治、经济的必然产物。
