在劳动合同的履行过程中,用人单位违法解除劳动合同的行为,严重损害了劳动者的合法权益。如何认定用人单位违法解除劳动合同的法律责任,在劳动仲裁实践过程中还存在许多争议。本文通过案例,分析了劳动仲裁机构在处理用人单位违法解除劳动合同时的法律适用问题,并阐述了用人单位承担违法解除劳动合同法律责任的三种形式。
During the performance of the labor contract, the employing unit illegally lifted the labor contract seriously harmed the legitimate rights and interests of the workers. How to identify the legal liability of employers to lift the labor contract illegally has many controversies in the practice of labor arbitration. This article analyzes the legal application of labor arbitration institution in dealing with the illegal termination of labor contract by employing arbitration institution, and expounds the three forms that the employer undertakes the legal liability of illegally lifting the labor contract.
