城镇就业农民工是指户籍属于农村,而在城镇务工,靠此生存的长期或临时从事非农产业的劳动者。据统计,目前全国进城务工和乡镇企业就业的农民工总数超过2亿,其中进城务工人员1.2亿左右。目前我国为保护农民工合法权益,针对农民工就业、工资、工伤医疗保险等问题颁布了很多政策。但是现实的法律法规,对农民工权益保障内容的界定和侵害农民工权益的处罚方法以及保障实行措施都未做出明确的规定,其执行力相对仍较低,加之城乡二元结构背景下的户籍制度没有妥善解决,农民工生产和生活条件也并未得到很好的改善。本文笔者将针对城镇就业农民工就业中权益保护的问题进行研究,并提出相关对策。
Urban employment Migrant workers refer to those long-term or temporary workers engaged in non-agricultural industries who live in rural areas while working in urban areas. According to statistics, at present, there are more than 200 million migrant workers in cities and township enterprises employed in the country, including about 120 million migrant workers in cities. At present, in order to protect the legitimate rights and interests of migrant workers, our country has promulgated many policies on such issues as employment of migrant workers, wages and medical insurance for work-related injuries. However, the actual laws and regulations have not made any explicit stipulations on the definition of the contents of safeguarding the rights and interests of migrant workers and the penalties for infringement on the rights and interests of migrant workers, as well as on the measures for safeguarding their implementation. Their enforcement power is still relatively low. Coupled with the urban-rural dualistic structure Household registration system is not properly resolved, migrant workers production and living conditions have not been well improved. In this paper, the author will study the employment protection of migrant workers in cities and towns and propose relevant countermeasures.
