【裁判要旨】最高人民法院《关于审理建筑物区分所有权纠纷案件具体应用法律若干问题的解释》明确规定建筑物的外墙属于共有部分,但业主对共有部分可以合理使用。底楼门面房业主在与其专有部分相对应的外墙面设置商店招牌属于合理使用,无需征得其他业主同意,亦无需支付费用,但不能超过必要限度,亦不能损害其他业主的合法权益,否则构成侵权,应当承担相应的民事责任。
Interpretation of the Supreme People’s Court on Several Issues Concerning the Specific Application of Law in the Trial of Disputes over the Differentiation of Ownership of Buildings clearly stipulates that the external walls of a building belong to a common part, but the owners can use the common part rationally. The owners of the ground floor house owners who set up shop signs on the external walls corresponding to their proprietary parts are reasonable to use without obtaining the consent of other owners or paying the fees but not exceeding the necessary limits or impairing the legitimate rights and interests of other owners. Otherwise constitute an infringement, should bear the corresponding civil liability.
