Article 1 of the WTO Government Procurement Agreement states: “This Agreement shall apply to any contractual form of procurement, including purchase, lease, installment purchase, purchase of options with and without purchase of goods and services.” "Therefore, Government procurement is called a government contract. The core of government procurement is buying. Contemporary government procurement is the government’s purchase of products, services and engineering as an independent civil subject. Under the background of market economy, government procurement requires the government to form and determine the rights and obligations with the other party by contract. Modern market economy countries have realized that the market is not a panacea, and that itself has flaws. In order to make up for the market shortcomings, the government began to extensively use economic measures and legal means to regulate the country
