欧洲共同体①于1997年在国际私法领域取得直接立法权后,欧盟委员会开始着手对欧盟合同之债的法律适用制度进行改革,以条例②的形式转化并修改了1980年订立于罗马的《合同之债法律适用的罗马公约》(以下简称《罗马公约》或《公约》),以便满足欧共体内部市场的顺畅运作对法律的统一性要求。对《公约》和取而代之的条例进行比较,分析其具体修改意见,归纳二者的优劣点,对于我们研究欧盟国际私法的发展方向和我国的区际法律问题无疑具有重要的意义。
The European Community (1) After obtaining direct legislative power in the field of private international law in 1997, the European Commission started to reform the law applicable system for debt under the European Union contract. In the form of Regulation (2), the EU law of 1980 Rome Convention on the Law Applicable to Debt (hereinafter referred to as the “Rome Convention” or the “Convention”) so as to meet the uniformity of law required by the smooth operation of the internal market of the EC. It is undoubtedly of great significance for us to study the development direction of the EU private international law and the interregional legal issues in our country by comparing the Convention and the regulations it replaces and analyzing its specific amendments and concluding the advantages and disadvantages of the two.
