竞业限制条款是现代企业保护商业秘密的法律手段之一,在维护公平的竞争秩序上也具有重要作用。为了平衡用人单位的商业秘密权与劳动者的就业权,《劳动合同法》做出了一些规定,然而,由于概括性的规定使得这一条款在实务中缺乏可操作性,存在着较大的一些争议,而这一条款既牵涉到个人利益,又涉及国家、企业利益。文章针对实务中出现的热点争议问题进行分析,探讨相应的解决对策和法律规制,以期待法律的进一步完善,促进该法的更好实施,构建和谐的劳动关系。
