2015年《中华人民共和国立法法》的颁布,使得一批设区的市成为新晋地方立法主体。新法实施前后,这些地方立法机构,可谓是面临着艰巨的思维转变过程。既是机遇,也是挑战。其中,环境保护方面的地方立法活动,作为发条中明定的地方立法权三项主要内容之一,尤为引起大家的广泛关注。近年来,在环保和宏观管理方面,很多地方政府都面临着紧迫的挑战,在发展经济的同时,如何平衡经济发展与社会共同利益,日益在环保领域突出出来。在这样的社会发展和法治建设的背景下,立法机制的适时调整,无疑为地方环保工作提供了法治保障。
The promulgation of the “Legislation Law of the People’s Republic of China” in 2015 made a number of municipalities establishing districts become the main body of new local legislation. Before and after the implementation of the new law, these local legislatures were indeed facing a difficult process of thinking change. It is both an opportunity and a challenge. Among them, the local legislative activities on environmental protection, as one of the three main contents of local legislative power in the law of winding-up, are of particular concern to all. In recent years, many local governments are facing pressing challenges in environmental protection and macroeconomic management. In the process of economic development, how to balance economic development with the common interests of the community is increasingly highlighted in the field of environmental protection. In the context of such social development and the construction of the rule of law, the timely adjustment of the legislative mechanism undoubtedly provides the rule of law protection for local environmental protection work.
