美国的网上立案制度,是其庞大的法院案件管理系统:PACER与CM/ECF系统的重要组成部分。通过对这两大系统的介绍与网上立案流程的分析,文章认为其网上立案系统符合司法实践的发展要求,并具有自己的优点。其中,网上立案与网上提交其他诉讼材料相结合、由美国法院管理办公室统一研发供各(联邦)法院使用的系统等做法,尤其值得正在进行网上立案实践的中国法院借鉴。就我国而言,尽快建立统一的网上立案系统,由各地法院根据自己实际情形选择适用,不仅保证了统一性和差异性的并存,也为以后司法审判的全程电子化,以及审判公开的深入贯彻,打下良好基础。但是,我国的相关法律与制度仍有与网上立案不协调之处,迫切需要进一步改进。 The United States' online filing system is its huge court case management system: an important part of the PACER and CM / ECF systems.
