2011年康菲溢油事件把要求修改环境保护法的呼吁推向历史新高潮,并成功推动1989年《环境保护法》和1999年《海洋环境保护法》完成修改。但仅仅依靠修改一两部环境法律是否就可以达到有效规制跨国企业污染行为之法律效果,并完成对被侵权者的司法救济之重任,确实还应该再行反思。司法过于行政化、环境司法适用实践匮乏以及缺乏相应系统化启动机制是立法完成后难以有效实施的现实根源。另外,我国司法适用缺乏国际话语权亦是另一重要原因。革除诟病、创新机制并提高国际司法地位应是解决问题之关键。
The 2011 ConocoPhillips oil spill took the call for amending environmental protection laws to a new height in history and successfully pushed for changes in the Environmental Protection Act of 1989 and the Marine Environmental Protection Act of 1999. However, relying solely on amending one or two environmental laws can achieve the legal effect of effectively regulating the pollution of transnational enterprises and accomplish the task of judicial relief to the infringer. Indeed, it should be reconsidered. Judicial over-administration, the lack of practical application of environmental justice and the lack of a corresponding systematic start-up mechanism are the root causes of the difficulty of effective implementation after the legislation is completed. In addition, the lack of the right to an international voice in the judicial application of our country is another important reason. To eradicate criticisms, innovate mechanisms and raise the status of international justice should be the key to resolving the issue.
