喻女士咨询:近年来,我所在的软件公司每逢节假日之前都会发出通知,职工可自愿报名加班。凡愿意加班者,法定节日加班费为平日工资的1.5倍,双休日加班费则只按工资标准支付。大概估算了一下,从2011年到现在,我们每个人领取的加班费累计比国家规定标准计算的少了将近1万元。我们曾向公司提出加班费支付标准问题,公司的答复是,加班为员工自愿,并非公司要求,所以不能按照有关规定支付报酬。
