2007-2008美国编剧协会大罢工对美国娱乐产业造成了巨大的冲击,随后,中国影视编剧受美国同仁鼓舞也开始了一系列具有争议性“维权”活动。本文第一部分较完整地梳理了美国编剧协会罢工过程,从法律专业层面进行了分析和评论;第二部分关注在跨文化误读语境中的中国编剧维权活动,指出了两国不同法律体系的“范式不可通约”。文章结论是:中国编剧维护既有的“中学为体,西学为用”传统,勉为其难的维权尝试不会触动主流价值体系和基本分配格局。
2007-2008 The strike by the American Screenwriting Association caused a tremendous impact on the entertainment industry in the United States. Subsequently, Chinese film and television dramas, encouraged by their American counterparts, also started a series of controversial “rights defense” activities. The first part of this article combs the striking process of the American Screenwriting Association completely and analyzes and comments from the legal professional level. The second part focuses on the activities of Chinese screenwriters in the context of cross-cultural misinterpretation, points out the differences between the two legal systems “Paradigm can not be about ”. The conclusion of the article is that the Chinese screenwriter maintains the traditional “middle school as the body, Western ” as the traditional, reluctant rights activist attempt will not touch the mainstream value system and the basic distribution pattern.
