现行《中华人民共和国经济合同法》颁行已逾十载,在改革开放形势日新月异、市场经济大潮汹涌而来的大背景下,立法和现实的矛盾越来越突出,不少法律条文在经济实践面前已显露出捉襟见肘的窘境,修改经济合同法迫在眉睫.在此,笔者想就《经济合同法》修改的总体思路,从宏观角度谈些自己的看法,就教于大方.
