随着欧洲一体化进程的深入,欧盟不得不面对一个复杂共同体的治理难题。试验主义治理模式的出现有效地应对了这一挑战。这一模式的核心机制是同行审议和惩罚性缺省。它通过基于执行经验的反复迭代过程实现了规则的制定和修正。这一模式的出现挑战了欧盟治理中既有的观念和信条。中国比欧盟更早地开始运用这一机制实现大国的治理和转型。只是这一机制在当下中国面临着越来越多的限制,而欧盟的试验主义却在国际范围内影响日益增大。我们应该在追求法治化目标的同时,努力保持体制的灵活性。
With the deepening of the process of European integration, the EU has to face the governance challenges of a complex community. The appearance of the experimental governance model has effectively tackled this challenge. The core mechanism of this model is peer review and punitive defaults. It achieves the formulation and revision of rules by iterative process based on the execution experience. The emergence of this model challenges the notions and credo that have existed in EU governance. China started using this mechanism earlier than the EU to realize the governance and transformation of the great powers. Only this mechanism is facing more and more restrictions in the present China, while the EU’s experimentalism has been increasingly influential in the international arena. We should strive to maintain the flexibility of the system while pursuing the goal of the rule of law.
