2002年8月,居住在温州的李某欲将其在杭州的一套100平 方米的房屋出售给王某。王某以前曾租住过这一小区,感觉较好。 但该房屋现由丁某租住。温州李某将这一出售信息用信寄给丁某, 但丁某未收到。后该房屋以50万元价格被王某买得。王某以自己 已购买该房屋为由要求现租住户丁某搬离该处房屋。丁某称其租 住的房屋是李某的,且有租赁协议,自己是承租人有优先购买权, 拒不搬出。李某则称事先已将售房意向寄信通知丁某,丁某未表 态。但丁某称自己未收到信件,并不知情。购房人壬某急于用房,遂 将丁某告到法院,要求丁某搬离该房。
