劳动教养是对被劳动教养的人实行强制性教育改造的行政措施,是处理人民内部矛盾的一种方法。作为中国特有的法律制度,劳动教养制度一直是我国法律体系中重要的一环。本文回顾了我国劳动教养制度的发展进程,剖析了当前构建和谐社会背景下劳动教养制度面临的困境,并在此基础上提出了改革和完善劳动教养制度合理化建议。
Re-education through labor is an administrative measure of compulsory education and reform for those who have been reeducation through labor. It is a method of dealing with contradictions among the people. As China’s unique legal system, the system of re-education through labor has always been an important part of our legal system. This article reviews the development of the system of reeducation through labor in our country, analyzes the difficulties that the reeducation-through-labor system faces in the current context of building a harmonious society, and on this basis proposes the proposals for rationalization and reform of the reeducation-through-labor system.
