虽然红头文件有被任性滥用的现象,但党政机关以红头文件的方式实施正常的公共管理仍然具有其现实合理性。红头文件本身没有原罪,也必然会继续存在下去,错在个别基层政府机关的任性滥用。因此,亟需通过进一步完善立法审查制度、行政立法授权制度、地方人大立法制度,有效防止红头文件滥用,加快推进法治国家和有限政府建设。 Although the red tape has been arbitrarily abused, the normal public administration carried out by party and government organs in the form of red tape still has its realistic rationality. The red tape itself does not have original sin and will inevitably continue to exist and be mistaken in the arbitrary abuse of individual grass-roots government agencies. Therefore, it is imperative to accelerate the building of a country under the rule of law and a limited government by further improving the system of legislative review, the system of authorizing administrative legislation and the legislative system of local people’s congresses so as to effectively prevent abuse of red-flag documents.
