美国针对频发的性暴力侵害犯罪案件,首创了性犯罪记录之登记与公告制度,目前西方各国几乎都建立了较为完善的性犯罪人登记制度,甚至加强了国家之间的信息沟通与合作,但却对社区公告制度普遍采取谨慎态度,即使在美国该制度也引起了广泛的争议,司法判决也各不相同。我国目前正处于向陌生人社会过渡的阶段,失去熟人间的相互监控会导致性侵犯案件急剧增加,因此有必要探讨“梅根法”在我国的适应性,并借鉴他国经验,建立一个适合于我国的性犯罪记录制度。
The United States has initiated the registration and announcement system of sexual crimes record against the frequent cases of sexual violence. At present, almost all western countries have established a relatively complete system of registration of sex offenders and even strengthened the communication and cooperation among countries. However, the community notice system is generally cautious, even in the United States the system has caused widespread controversy, judicial decisions vary. At present, China is in the stage of transition to a stranger society. The loss of mutual monitoring of acquaintances will lead to a sharp increase in cases of sexual assault. Therefore, it is necessary to explore the adaptability of “Meggis ” in our country and learn from the experience of other countries to establish a Suitable for China’s sexual crime record system.
