死刑复核程序的基本功能目标是对法院的死刑裁判权进行有效制约,为遭受死刑裁判的被告人提供有效的司法救济。基于此二目标,死刑复核程序总体上具有行政审批与司法审判的双重属性,程序构造应当关注被告人对这一程序的实质参与。死刑复核程序的具体设计则应当包括程序启动方式、审理的范围与具体方式、复核结果的法律形式、复核的期间的限制等。
The basic function of the death penalty review procedure is to effectively restrict the court’s death penalty jurisdiction and provide effective judicial relief to the defendants who have suffered death penalty referee. Based on these two objectives, the death penalty review procedure has the dual attributes of administrative examination and approval and judicial trial as a whole. The procedure construction should pay attention to the substantive participation of the accused in this procedure. The specific design of the death penalty review procedure should include the starting procedure of the procedure, the scope and specific method of the trial, the legal form of the review result and the limitation of the review period.
