在现代风险社会,风险规制逐渐成为现代国家的一项基本任务。面对具有高度复杂性和不确定性的现代风险,以交涉性和反思性为本质特征的现代程序在风险规制中的意义日益凸显。以“司法程序”为模型的传统行政程序呈现出高度的封闭性与对抗性,难以为风险规制的多元主体的论辩与协商提供足够的制度空间,应当建构一种风险规制的“分析—协商”程序,从而为包括风险规制机构、专家、利益相关者、普通公众在内的多元主体就风险议题展开协商论辩提供制度性平台。我国风险规制应当倡导一种新程序主义的法治路径,以促成风险规制决策的合法性。
In the modern risk society, risk regulation has gradually become a basic task of modern countries. In the face of the modern risks with high complexity and uncertainty, the significance of modern procedures based on the nature of negotiation and reflection on risk regulation has become increasingly prominent. The traditional administrative procedure based on the model of “judicial procedure” shows a high degree of confinement and confrontation. It is difficult to provide sufficient institutional space for argument and negotiation of multiple subjects of risk regulation. Therefore, it is necessary to construct a “risk analysis” - Consultation "procedure, which provides an institutional platform for the consultation and discussion of risk issues among multiple subjects including risk regulatory agencies, experts, stakeholders and the general public. China’s risk regulation should advocate a new procedural legal path to promote the legitimacy of risk regulation decisions.
