“宪法是母法”的观点在我国宪法研究和立法实践中有着重要影响,其理论基础是凯尔森的“法律位阶理论”。在这种观点下,宪法被认为是普通法律的立法基础,普通法律则被看做宪法的具体细化。宪法母法说在规范形态上表现为“授权规范说”。在处理宪法和法律的关系上,应实现从“授权规范说”到“违宪无效说的”的价值转变。 “Constitution is the mother ” point of view has an important influence in the constitutional research and legislative practice in our country, and its theoretical basis is Kelsen ’s “theory of legal order ”. In this view, the Constitution is considered as the legislative basis for ordinary law, while ordinary law is seen as a concrete refinement of the Constitution. The mother tongue of the Constitution says that it behaves in a canonical form as “authorized norms ”. In dealing with the relationship between the Constitution and the law, we should realize the value transformation from “authorized norms ” to “unconstitutional”.
