美国自1982年以来一直将“教导-启示-动机”标准奉为判断专利非显而易见性的金科玉律,但在最近的KSR案件中却对其作了具有里程碑意义的修改。本文在介绍KSR案件技术背景和案件流程的基础上,评析了该案和“教导—启示—动机”标准,分析了目前美国最高法院所确立的非显而易见性的判断方法,最后指出了本次修改对美国业界的影响和对我国专利审查的启示,从比较法的角度提出了若干立法建议,以期能抛砖引玉,进一步完善我国专利制度。
Since 1982, the United States has regarded the “teaching-apocalypse-motivation” standard as the golden rule in determining the non-obviousness of a patent, but has made landmark changes in recent KSR cases. On the basis of introducing the technical background and case flow of KSR case, this paper analyzes the case and the criterion of “teaching-enlightenment-motivation”, analyzes the non-obvious judgment method established by the Supreme Court of the United States, and finally points out that this The second revision of the impact on the United States industry and the enlightenment of our country’s patent examination, from the perspective of comparative law put forward a number of legislative proposals, with a view to throwing light on jade, and further improve our patent system.
