法学教育方法从来都不是凭空产生的,一个国家或民族的法律教育方法必然打上其法律传统和文化的烙印。所以,我们在学习或借鉴西方法学教学方法时应当处理好两个方面的问题:一是外国教学方法自身的本土化;二是外国教学方法与本土教学方法的融合和对接,切忌生搬硬套或片面否定本土传统的教学方法。否则,既不利于现代西方法学教学方法的引进,也不利于本土教学方法的改革和创新。鉴于此,我们模拟司法过程与学生法律思维流程,将法学课堂划分为“问”、“读”、
