案例甲公司以拍卖方式取得一宗国有土地70年的使用权。2003年3月15日,甲公司与当地国土资源管理局签订了《国有土地使用权出让合同》,并在合同中约定,同年5月15日由出让人将达到合同约定使用条件的土地交付于甲公司使用,同时约定出让年限按约定的交付土地之日起起算。在按期取得土地使用权后,甲公司于2004年8月1日到当地国土资源管理部门办理了土地使用权登记,并取得了合法的土地使用权证书。2008年5月,甲公司将该宗土地使用权转让给乙公司,双方在关于土地使用权剩余期限的问题上发生严重分歧。乙公司认为,应该从2004年8月1日土地使用权登记之日起起算70年,因此剩余期限为66年;而甲公司则认为,应该从2003年5月15日土地交付之日起起算70年,剩余期限为65年。
Case A Company obtained an auction of 70 years of state-owned land use rights. On March 15, 2003, Company A and the local Land and Resources Administration signed the Contract for the Sale of State-owned Land Use Rights and agreed in the contract. On May 15, the same year, the transferor shall deliver the land that has reached the contractually agreed conditions of use A company to use, at the same time agreed to sell the agreed period of land delivery date. After obtaining the land use right on schedule, Company A handled the registration of land use right with the local land and resources administration department on August 1, 2004 and obtained the legal certificate of land use right. In May 2008, Company A transferred the use right of the said land to Company B, and the two parties made serious disagreements on the remaining term of the land use rights. Company B believes that it should be 70 years from the date of registration of the land use rights on August 1, 2004, so the remaining term is 66 years, while Company A thinks it should start from the day of delivery of the land on May 15, 2003 70 years, the remaining period is 65 years.
