2007年3月16日通过的《中华人民共和国物权法》第106条明确规定了不动产可以适用善意取得制度。但是立法对这一问题的定论并不表明是终局性的定论,尚有值得探讨的余地。本文认为,第三人取得不动产所有权是基于登记的公信力,而不是基于善意取得制度。对不动产是否适用善意取得制度之争的缘由在于对登记公信力和善意取得制度的认识混淆。
Article 106 of the “Property Law of the People’s Republic of China” passed on March 16, 2007 clearly stipulates that a goodwill acquisition system can be applied to real property. However, the conclusion made by the legislature on this issue does not mean a final conclusion. There is still room for discussion. This paper argues that the third party’s ownership of real property is based on the credibility of registration rather than on the system of bona fide acquisition. The reason for the dispute over the good faith acquisition of real estate lies in the confusion about the system of registration credibility and goodwill acquisition.
