高校教师权利的有效保障,是依法治校的必然要求,也是充分调动教师积极性、主动性和创造性,保障高校教育教学质量的关键。梳理现有法律框架下的高校教师权益保障机制,借鉴美国先进经验,把教师权益保障体系视为一个包括诸多要素及其相互关系的系统,提出完善高校教师权益的理念保障机制、组织保障机制、制度保障机制(包括立法保障、司法保障、行政保障)以及其他保障机制,以构建一套多元高效、相互协调的高校教师权益保障机制。
The effective protection of college teachers’ rights is the inevitable requirement of governing the university according to law, and also the key to fully mobilize the enthusiasm, initiative and creativity of teachers to ensure the quality of education in colleges and universities. Combining the existing legal framework for the protection of rights and interests of university teachers, drawing on the advanced experience of the United States, the system of teachers’ rights and interests as a system that includes many elements and their interrelationships, the concept of perfecting the rights and interests of university teachers, safeguard mechanisms, organizational security mechanisms, System guarantee mechanism (including legislative guarantee, judicial guarantee, administrative guarantee) as well as other safeguard mechanisms, in order to build a set of multiple, efficient and coordinated mechanisms for safeguarding the rights and interests of university teachers.
