国务院发布的《全面推进依法行政实施纲要》指出,实行行政执法人员资格制度,没有取得执法资格的不得从事行政执法工作。对行政执法人员的资格管理一般是通过确认行政执法资格、颁发行政执法证件和对行政执法证件的管理实现的,而行政执法证件的年度审核注册管理,又是行政执法证件管理的一个重要环节。对于行政执法证件的年审,每个政府法制机构和行政执法部门都会在工作中遇到,都可能有许多理论和实际的问题需要澄清和加以解决,但目前很少有专门的文章研究提供借鉴,对工作加以指导,因此,有必要就行政执法证件的年审作一研究和探讨。
