一、工会在劳动关系中的基本作用基于《劳动合同法》明确了工会在劳动者与用人单位之间形成和实现劳动合同关系中的权利,也就为工会在劳动合同法中的作用提供了依据。这些作用表现在劳动合同关系中的五个方面:(一)对于劳动者在劳动合同关系中的权益认定,工会发挥的是指导作用。劳动合同关系的产生,以劳动者进入用人单位为前提。通过工会的帮助指导,避免劳动者个人在无法明确认定自身合法权益的情况下签订劳动合同。
