2007年始,瑞士全部9所法律院系中的23名私法学者开始联合着手编写债法总则改革建议草案(简称OR 2020),从而革新现行债法的第一分编。在刚庆祝完瑞士现行债法实施100周年之后的2013年,这一学者建议草案正式出版发行,并获得了政治上的一些支持。有联邦议员提出动议,以这部学者建议草案为基础,开展现行债法总则的变革,并获议会采纳从而正式启动立法修改程序。虽然目前这一学者建议草案最后变为立法现实的前景还不明朗,但对这一草案推出的背景和目标、起草过程和方法、体例更新和内容变化等方面进行考察,对于我国未来民法典的起草、债法总则的制定和具体制度的完善都有其学术价值和现实意义。
Beginning in 2007, 23 private law scholars from all 9 law departments in Switzerland started joint work on drafting a draft proposal on reform of the general law on debt (OR 2020 for short), thereby reforming the first series of existing debt laws. In 2013 just after celebrating the 100th anniversary of the implementation of the existing debt law in Switzerland, the scholar proposed that the draft be formally published and with some political support. A federal parliament member moved a motion to reform the general principles of the current debt law on the basis of the draft of the scholar’s proposal and was adopted by the parliament to formally initiate the legislative revision process. Although the current scholars’ suggestion that the draft finally turns into a legislative reality is unclear, the background and objectives, the drafting process and methods, the updating of the system and the content changes of the draft will be examined. For the future civil code of our country The drafting, development of the general rules of debt and the improvement of the specific system have their academic value and practical significance.
