生态行政是21世纪行政法的新理念。推行生态法治行政理念、构建生态型政府,是当代政府改革发展的新目标。康菲石油案这一生态环境的热点事件,引发了对当前我国海洋生态补偿法律制度现状的反思。我国海洋生态补偿的行政立法层次较低,相关法律资源缺乏系统性整合与疏理,加之程序法的部分缺位,救济手段与救济程序不完备以及行政执法主体的不明确和问责制的缺乏等问题严重制约了我国海洋生态补偿的实践。为此,在生态行政的视角下进一步完善我国海洋生态补偿的实体法、程序法,并建立海洋生态补偿的监管机制,明确执法主体和严格问责制,这些措施将有助于规范和推动我国海洋生态补偿的实践。
Ecological administration is a new concept of administrative law in the 21st century. The implementation of the concept of ecological law and administration and the construction of an ecological government are the new goals of the reform and development of the contemporary government. The administrative and legal level of marine ecosystem compensation in our country is relatively low, and there is a lack of systematic integration and deconstruction of relevant legal resources. In addition, the absence of procedural laws, incomplete remedies and relief procedures, and the lack of clarity and lack of accountability And other issues have seriously hampered the practice of marine ecological compensation in China. To this end, the Substantive Law and the Procedural Law on marine ecological compensation in China are further perfected from the perspective of ecological administration, and the regulatory mechanism for marine ecological compensation is established to clarify the main body of law enforcement and strict accountability. These measures will help standardize and promote China’s Marine ecological compensation practice.
