新中国成立后,中国民兵建设进入了一个崭新的阶段。民兵第一次在法律上被确立为国家的一项重要军事制度。具有“临时宪法”作用的《中国人民政治协商会议共同纲领》第23条规定:“中华人民共和国实行民兵制度,保卫地方秩序,建立国家动员基础……”1950年5月,中共中央、中央军委又发出了《关于加强民兵建设的指示》,提出“把过去战争时期实行的自愿参加民兵的原则,变为按照规定的条件普遍参加民兵的制度。”这在根本上确立了新中国的民兵制度,为民兵建设奠定了坚实的基础。此后几十年间,党和政府一直把民兵作为国家武装力量的重要组成部分,把它与我们长期坚持的人民战争思想、积极防御的战略方针和保持国家长治久安紧密地联系在一起,并根据形势的需要,适时调整民兵建设的方针政策,不断加大投入力度,保证了民兵建设又好又快的发展。
