有关实习人员及企业上层高管人员的经验事实与法律文本之间存在断裂。就实习人员而言,需要做相应的类型化区分,根据不同情况作出建立劳动关系与否的判断,而我国的法律法规却没有相关的规定;就企业上层高管人员而言,任命方式、薪酬及身份的经验事实决定了企业上层高管人员与企业不能建立劳动关系,而我国的相关法律法规却作出了模糊的规定。
