马伯里的判决不仅了结了马伯里一案,更重要的是它深深地触及到美国的政治制度。因为这一判决扩大了最高法院的司法权限,使它拥有了宪法没有明文赋予的司法审查权,即审查国会立法是否违宪的权力。以后,马伯里诉讼案的判决成为一项司法先例,各级法院都有权援例审查政府法律和政令是否违宪,凡被法院认定违宪的法律一概宣布无效。其中,对涉及解释联邦宪法的诉讼案,联邦最高法院享有最后发言权。法院的司法审查权逐渐得到公认,成为美国立法体制中一项重要的政治制度。
Marbury’s verdict not only ended the case of Marbury, but more importantly it touched deeply on the American political system. Because this ruling enlarged the jurisdiction of the Supreme Court and gave it the power of judicial review not expressly granted by the Constitution, that is, the power to examine whether parliamentary legislation is unconstitutional. Later, the verdict of the Marbury suit became a judicial precedent. All the courts at all levels had the power to aide in examining whether the laws and decrees of the government were unconstitutional, and all laws found unconstitutional by courts were declared null and void. Among them, the Supreme Court of the United States has the final say on the lawsuit involved in the interpretation of the Federal Constitution. The court’s judicial review power gradually gained recognition and became an important political system in the U.S. legislative system.
