冲之鸟是岩礁还是岛屿,是否可以拥有专属经济区和大陆架,中国和日本对此一直存有很大争议。日本为使冲之鸟可以符合国际法中关于岛屿的标准,从而可以获得专属经济区和大陆架,对冲之鸟进行了一系列的人工活动。而中国则一直对日本声称冲之鸟是岛屿的说法持坚决反对态度。冲之鸟的属性为何会引起两国争议,在国际法中,冲之鸟究竟能否算作是岛屿,能否拥有其专属经济区和大陆架呢。面对此问题,本文通过对《联合国海洋法公约》的分析,来认定冲之鸟的属性。
Whether the red bird is a rock or an island, whether it can own an exclusive economic zone or the continental shelf, China and Japan have always had much controversy over this issue. Japan has made a series of human activities for Hedgehogs to meet the standards of the international law on islands so that exclusive economic zones and the continental shelf can be obtained. China, on the other hand, has always been strongly opposed to Japan’s claim that the bird is the island of Rakhine. Why does the nature of the red bird cause controversy between the two countries? In international law, can the red bird actually count as an island and can it own its own economic zone and the continental shelf? Faced with this problem, this article through the analysis of the “United Nations Convention on the Law of the Sea” to determine the properties of the red bird.
