本文通过个案研究,考察了我国西南某地区土地市场治理整顿及土地制度的变迁历程,揭示了地方政府如何通过土地经营筹措公共建设资金,以及如何调整“以地换路”、“以地换基础设施”的模式,并逐步建立规范的土地交易制度的过程。案例从微观角度充分展现了中国地方土地市场法制变迁中所面临的经济、政治等局限条件,以及地方政府改革完善土地交易法制的努力。该案例对于我们理解中国土地市场的历史变迁、理解中国的城市化和经济建设进程中所面临的困难和矛盾,以及地方政府在其中所起的复杂作用具有重要的样本意义。该案例也反映出,在法制变革的过程中,对各方主体的立场和诉求应有充分认识和合理照顾,以利于改革的顺利推进。
Through a case study, this paper examines the process of land market regulation and the change of land system in a certain area of southwest China, reveals how local governments raise funds for public construction through land management, and how to adjust “how to change places” Change infrastructure "model, and gradually establish a standardized system of land transactions process. The case fully demonstrates the limited economic, political and other conditions confronting the legal system of local land market in China from the microscopic point of view and the endeavor of the local government to reform and perfect the legal system of land transaction. This case is of great importance for us to understand the historical changes in China’s land market, understand the difficulties and contradictions China faces in urbanization and economic construction, and the complex role that local governments play in it. The case also reflects that in the process of legal system reform, the positions and appeals of all the parties should be fully recognized and rationally cared for, so as to facilitate the smooth progress of the reform.
