“基本权利不可克减”是紧急状态法制的重要法律原则。根据这一原则,即使在危及国家生存的紧急状态,一些基本权利也无论如何不能被克减。不可克减原则对国家克减公民权利设立了清晰的界限,直接体现了紧急状态法制的基本价值,有助于维护个人利益和公共利益间的平衡和少数人权利的保护。在我国紧急状态法制中确立不可克减原则是宪法人权保护原则的必要体现,是完善我国紧急状态法制,促进应急管理法治化的需要,也是政府未来履行国际义务的需要。为此,我国宪法应对克减权和不可克减的权利做出明确的规定。
“Non-derogable basic rights ” is an important legal principle of the legal system in an emergency. According to this principle, some basic rights can not be derogated from in any event, even in a state of emergency threatening the survival of the country. The principle of non-derogability set a clear boundary on the derogation of citizens’ rights and directly reflects the basic value of the emergency legal system, which helps to safeguard the balance between individual and public interests and the protection of minority rights. The establishment of the principle of non-derogable in the legal system of emergency in our country is the necessary reflection of the principle of constitutional human rights protection. It is the need of perfecting the legal system of our state of emergency and promoting the legalization of emergency management. It is also the need of the government to fulfill its international obligations in the future. For this reason, our country’s constitution should make a clear stipulation on the rights to derogation and non-derogability.
