实际承运人作为海上货物运输关系中一重要主体,其地位和作用是不容忽视的。然而自从我国《海商法》确立实际承运人制度开始,理论和实务界对其研究和探讨就从未停止。普遍认为,实际承运人概念中有关“委托”、“从事”、“运输”、以及“构成条件”等方面的规定存在着不同程度的不合理性;而将实际承运人定义为“承运人之外的,为完成海上货物运输,直接或者间接参与船舶经营或管理的人”则更科学一些。
As an important subject in the maritime trucking, the actual carrier can not be ignored in its status and function. However, since the beginning of the establishment of the actual carrier system in China’s “Maritime Law,” its theory and practical circles have never ceased its research and discussion. It is generally accepted that there are varying degrees of irrationality in the actual carrier concept regarding the provisions of “commission ”, “engaged ”, “transport ”, and “constituting conditions ”; The carrier is defined as “a person other than the carrier who is directly or indirectly involved in the operation or management of the ship for the purpose of the carriage of goods by sea” is more scientific.
