视听资料是指以录音、录像和电子计算机技术以及其他高科技设备所存储的音像信息证明案件真实情况的资料,是将现代科学技术运用到刑事诉讼中的一种证明手段。本文结合司法实践,探讨了视听资料作证的三个相关问题:视听资料在检察机关自侦案件中的运用、电子证据的收集与运用、讯问同步录音录像问题等。
Audio-visual materials refer to the materials that prove the real situation of cases based on the audio and video information stored by recording, video and computer technology and other high-tech equipment, and are a kind of demonstration means to apply modern science and technology to criminal proceedings. This article discusses three related issues of audio-visual materials testifying with judicial practice: the application of audio-visual materials in self-investigating cases of procuratorial organs, the collection and application of electronic evidence, the question of synchronous audio-video recording and so on.
