第一條本辦法依據‘發展都市建設並尊重私有土地所有權的權益’的精神制訂之。第二條公共建設範圍包括以下各項:(1)屬於擴大與發展都市建設計劃者:如修建道路、橋樑、下水道、河防。(2)屬於公用者:如修建公園、公厕、公墓、體育塲。(3)機關用者:如機關、國立市立學校、文化舘、圖書館、醫院使用。第三條第二條各項使用私有土地,得根據使用用途、土地及土地所有者狀况、數量、徵購徵借或徵用之。並得以公有土地交換。第四條被使用土地(包括徵購徵用及交換,下同)上之建築物得徵購之。無徵購必要時,所有人又不願拆遷者,得酌情付與價值,所有人願拆遷者,適當補助拆遷費。
Article 1 These Procedures are formulated in the spirit of ’developing urban construction and respecting the rights and interests of private land ownership’. Article 2 The scope of public construction includes the following items: (1) Those who belong to the expansion and development of urban construction plans: such as the construction of roads, bridges, sewers and river guards.
