一、“城中村”与宅基地使用权法律背景分析改革开放33年来,伴随着我国经济建设取得举世瞩目的成就,我国城市化进程与其相得益彰,大多数城市的规模较之改革开放初期扩大了3-5倍,有的甚至更大。[1]时至今日,全国很多城市仍在制定进一步扩张与发展规划,首当其冲的就是大城市周边的村镇或“城市内的农村”。这些农村在这一历史巨变中,逐渐被卷入了城市化大潮,有些学者形象的称其为“城市包围农村运动”。(一)“城中村”的概念由于研究者关注的角度不同,“城中村”至今没有统一的定义。有的学者从城乡二元空间形态进行定义,

The size of most cities expanded compared with the initial stage of reform and opening up 3-5 times, some even bigger. [1] To date, many cities in the country are still developing plans for further expansion and development, with the first and foremost being villages and towns or “rural areas within cities” around large cities. These rural areas have been gradually involved in the tide of urbanization in this historical turmoil. Some scholars call it the “urban encirclement of rural areas”. (A) The concept of “village in the city” Because of different perspectives of researchers, there is no unified definition of “village in city” so far. Some scholars define the dual spatial form of urban and rural areas,
